Section 5. Support services. From time to time, we may provide technical assistance in response to your request to help you use online services (“Help Services”). They authorize the UPS Capital Group and its authorized agents (the “Support Provider”) to provide remote support services over the Internet or through other means. During these remote sessions, support service providers can help you change your computer systems. By requiring and receiving support services, you also allow us and support providers to manipulate and modify your computer systems, applications, files and data as rightly as possible to provide support services. You acknowledge and accept that support services are provided at our discretion and that nothing in this agreement is interpreted to compel us or the support provider to provide assistance services. You acknowledge and accept that you may disclose your information and data when providing support services, or respect it by us or support providers, and that this information and data is considered non-confidential and therefore not under Section 4 (Confidentiality) of this Agreement. In addition, you recognize that remote communication sessions for the provision of support services can be implemented over the Internet, which is inherently uncertain, and you agree that neither we nor any of the support providers will be held responsible for errors, including, but not exclusively, security breaches that occur on the Internet. You agree to take the above into account when requesting assistance services. 5.2 Access to proprietary information. You recognize and agree that you may disclose your information and data when providing support services through UPS or support providers, or that you can view it with UPS or support providers; and that this information and data is considered non-confidential and therefore does not fall within the terms and conditions of sale of Article 7, unless UPS has otherwise agreed to it in a confidentiality agreement separate from this Agreement. In addition, you acknowledge that remote communication sessions used by UPS or support providers can be implemented via the Internet, which is inherently uncertain, and you accept that UPS or support providers are not held responsible for Internet security breaches.
